Terms & Conditions: Demonstrations, Tours, Room-Hire & Accommodation
1. These terms
1.1 These are the terms and conditions on which our Wildlands take bookings for accommodation and/or campsite and/or tours & demonstrations and/or meeting and conference venues.
1.2 Please read these terms carefully before you make your booking. These terms tell you about Nattergal, which company your contract is with, how your booking is taken, how the contract for your booking is formed, how you and the relevant Wildland company may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss (contact information is in clause 2).
1.3 Please note, some parts of these terms only apply to consumers and other parts only apply to business customers. It is made clear in these terms if this is the case. You are a consumer if you are an individual acting for purposes that are wholly or mainly outside your trade, business, craft or profession. You are a business customer if you are acting for purposes relating to your trade, business, craft or profession, whether acting personally or through another person acting in your name or on your behalf.
2 Information about us, your booking agreement and how to contact us
2.1 Each of the Wildlands displayed as available for bookings on the website www.nattergal.co.uk is operated by a subsidiary company of Nattergal Limited (Company Number 13661114 whose registered office is at c/o External Services Limited, 20 Central Avenue, St Andrews Business Park, Norwich NR7 0HR) (“Nattergal”).
2.2 It is important to note that all tours, demonstrations, room hire, camping and accommodation are provided by Nattergal Limited’s subsidiary companies. This means that your booking (and contract) will be with one of the following companies depending on which Wildland the activity you are booking will take place:
· If your booking relates to Boothby Wildland then your contract is with Boothby Wildland Limited (Company Number 13709852) whose registered office is at c/o External Services Limited, 20 Central Avenue, St Andrews Business Park, Norwich NR7 0HR
· If your booking relates to High Fen Wildland then your contract is with High Fen Limited (Company Number 14452525) whose registered office is at c/o External Services Limited, 20 Central Avenue, St Andrews Business Park, Norwich NR7 0HR
· If your booking relates to Harold’s Park Wildland then your contract is with Harold’s Park Wildland Limited (Company Number 15566075) whose registered office is at c/o External Services Limited, 20 Central Avenue, St Andrews Business Park, Norwich NR7 0HR
The company with which your contract is made will be referred to as ‘the relevant Wildland company’ in these terms and its site as ‘the relevant Wildland’ or ‘the Wildland’.
2.3 How to contact the Wildlands
You can contact our Wildlands about all tours, demonstrations, room hire, camping and accommodation (no matter which Wildland your booking relates) by emailing the central booking email address which is bookings@nattergal.co.uk. If you need to write to any of our Wildlands by post, please write to our central postal address which is Nattergal PO Box 289 Thetford IP25 7YW.
2.4 How the Wildlands will contact you
If our Wildlands need to contact you about your booking they will do so by telephone or by writing to you at the email address or postal address you provided in the booking form.
2.5 When the words “writing” or “written” are used in these terms, this includes emails.
3 Confirming your booking
3.1 To make a booking, you will need to complete the booking form on Nattergal’s website and pay the quoted price in full (as displayed on the website). Your booking is only considered to be accepted and confirmed when the relevant Wildland company emails you to confirm that we have accepted your booking (the booking confirmation) at which point the contract between you and the relevant Wildland company will be formed.
3.2 The booking form will clearly state:
3.2.1 what dates you have booked the accommodation and/or campsite and/or tour or demonstration and/or venue;
3.2.2 check in and check out times;
3.2.3 any additional extras you have added; and
3.2.4 the number of people staying and/or camping and/or attending our tour or demonstration and/or venue.
3.3 Please ensure all the information on the booking form is correct before agreeing to these terms and making payment.
3.4 If the relevant Wildland company is unable to accept your booking, it will inform you of this and will not charge you for your booking. This might be, for example, because the campsite or venue is already booked, because of unexpected limits on resources which it could not reasonably plan for, because it has identified an error in the price or description of your booking, because it is unable to meet a date you have specified, or because it considers your proposed booking may damage its or Nattergal’s reputation or image. Please note booking will not be accepted from any hen parties, stag dos, other large groups or any groups who where the majority of those attending are under 18 years of age.
4 If you are a business customer
4.1 This paragraph 4 only applies if you are a business customer
4.2 If you are not a consumer, you confirm that you have authority to bind any business on whose behalf you book a tour or demonstration and/or camping and/or venue.
4.3 These terms, the booking form, and the final details (provided under paragraph 8) constitute the entire agreement between you and the relevant Wildland company and supersede and extinguish all previous agreements, promises, assurances, warranties, representations and understandings, whether written or oral, relating to its subject matter.
4.4 You acknowledge that in entering into the contract you do not rely on any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these terms or any document expressly referred to in them
4.5 You and we agree that neither you nor the relevant Wildland company shall have any claim for innocent or negligent misrepresentation based on any statement in the contract.
5 Price and payment
5.1 The online booking form indicates the total price of your stay, visit and/or tour or demonstration (which includes VAT). This will include any additional extras you have chosen to add.
5.2 You may make payment by card, over the phone, or the relevant Wildland company can provide you with a hard copy invoice. Your booking will not be confirmed until the relevant Wildland company has issued you with a booking confirmation – see paragraph 3.1.
5.3 [AH1] All bookings are non-refundable, except in the circumstances detailed in paragraph 21.
6 If you want to change to your booking
6.1 If you wish to make a change to your booking in any way, please email the central booking email address bookings@nattergal.co.uk. The relevant Wildland company will let you know if the change is possible. If it is possible the relevant Wildland company will let you know about any changes to the price of the booking, or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.
7 If we need to change or postpone your booking
7.1 The relevant Wildland company may change or postpone your booking:
7.1.1 to reflect changes in relevant laws and regulatory requirements;
7.1.2 make changes to the booking and/or services as requested by you or notified by it to you (see paragraph 6);
7.1.3 to implement minor technical adjustments and improvements, for example to address a security threat; or
7.1.4 in response to an event outside our control (see paragraph 21).
You understand these changes may affect your booking.
7.2 The relevant Wildland company will contact you in advance to tell you that your booking will be changing or being postponed, unless the problem is urgent or an emergency. You may contact the relevant Wildland company to end the contract for a booking if it is postponed and you will be refunded for sums you have paid in advance for the booking by the relevant Wildland company
8 Arrival and departure times
8.1 For camping, check in will be from 1pm on the day of your arrival. You must have checked out by 11am on the day you are due to depart.
8.2 For glamping and the Annex check-in will be from 4pm on the day of your arrival. You must have checked out by 11am on the day you are due to depart.
8.3 If you have booked a tour or demonstration, you must arrive at the location specified on your booking confirmation no later than 15 minutes before the tour or demonstration is due to start.
8.4 For venue hire, timings will be bespoke and as specified by the relevant Wildland company in writing.
9 Entry and security
9.1 Nothing in the contract shall be considered to give you a tenancy on the relevant Wildland site or any part thereof, nor does the contract confer on you any right to exclude any other person or organisation.
9.2 For security reasons and other considerations the relevant Wildland company may, at any time, and for any reason without it incurring liability to you or any third party:
9.2.1 refuse entry to any person, vehicle or piece of equipment on to the relevant Wildland site; or
9.2.2 remove any person, vehicle or piece of equipment from the relevant Wildland site.
9.3 You and your party must at all times comply with the security and health and safety rules governing conduct at the relevant campsite and tour or demonstrations, as well as the instructions of staff of Nattergal or the relevant Wildland company. Because of the rural locations, natural hazards, such as uneven and slippery surfaces, animal burrows, deep water ponds and ditches, are common. Please always exercise care around the campsite and on tour or demonstration or whilst using the venues to help prevent personal injury.
10 Campsite and Accommodation General Rules
10.1 With the exception of the Annexe, everyone in your party must be over the age of 7 unless agreed by the relevant Wildland company in writing in advance.
10.2 You and your party must at all times behave in such a way so as not to cause or likely to cause a nuisance or unreasonable disruption to other campers, guests, staff or to anyone else.
10.3 If you or your guests refuse to or appear to be unable to alter any aspect of behaviour that is unacceptable to us, the relevant Wildland company reserves the right to end the stay of the person(s) involved, you or all of your party.
10.4 All tents must be pitched not less than 6 metres apart, including any guy ropes.
10.5 We do not allow amplified music at any time and all noise should be kept to a minimum between 9.30pm and 9.00am.
10.6 Sky and/or Chinese lanterns are not to be released.
10.7 When camping, all rubbish must be cleared away prior to check out and your pitch must remain in a tidy condition.
10.8 All smoking (including e-cigarettes) is prohibited inside any Wildland buildings and structures. Smoking is only permitted outside. You must ensure all cigarette butts are only deposited in the sand buckets provided.
10.9 Although campfires and BBQs are permitted on the campsite, these must not be placed directly on the grass or soil – please use the fire-pits and/or BBQ stands. Firewood and kindling can be purchased at on-site, or pre-ordered when you make your booking.
10.10 All fireworks and sparklers of any kind are strictly prohibited.
10.11 All swimming in the waters on our grounds is strictly prohibited.
10.12 You and your party must agree to follow the Countryside Code.
11 Tour or demonstrations
11.1 Anyone under the age of 7 will not be permitted to take part in tours or demonstrations unless agreed in advance.
11.2 Some tours or demonstrations may be taken in Wildland vehicles. If for any reason a vehicle is not available for a vehicle-based tour or demonstration, the relevant Wildland company reserves the right to continue with the tour or demonstration as a guided walking tour. It is strongly advised that you and your party wear suitable footwear.
11.3 During a vehicle tour or demonstration, you must remain in the vehicle at all times, unless your guide informs you otherwise.
11.4 For all tours, you must follow all instructions given by the guides.
12 Animals and pets
12.1 The Wildlands may become home to a large number and diverse range of wildlife. These animals need to be able to roam and interact with each other as freely as possible in our rewilding project and are not domesticated animals or conventional farm livestock. In order to preserve the integrity of their herd behaviour and mentality, whether you are camping, or on a tour or demonstration, you should not approach or try to touch or feed any of the animals.
12.2 Dogs must be kept on leads within our wildlands.
13 Food and drink
13.1 You may bring food and drink (including alcohol) to your camping pitch.
13.2 Alcohol may only be consumed at your pitch.
14 Wi-Fi
14.1 Free Wi-Fi is provided in certain areas of the Wildland. If you require use of the Wi-Fi, please ask a member of staff who will provide you with a network password.
14.2 You may not use the relevant Wildland company’s Wi-Fi network to:
14.2.1 breach any applicable local, national or international law or regulation or to facilitate illegal activity;
14.2.2 bully, insult, intimidate or humiliate any person;
14.2.3 transmit any unlawful, harmful, defamatory, discriminatory (whether on grounds of race, gender, colour, religious belief, sexual orientation, or disability) or obscene material;
14.2.4 transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation; or
14.2.5 knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
15 Your rights to end the contract
15.1 If you are ending a contract for a reason set out further below in this paragraph 15.1 the contract will end immediately and you will be refunded by the relevant Wildland company in full for any services which have not been provided and if you are a consumer, you may also be entitled to compensation. The reasons are:
15.1.1 the relevant Wildland company has told you about an upcoming change to your booking or these terms which you do not agree to (see paragraph 7);
15.1.2 the relevant Wildland company has moved your booking for technical reasons, or notifies you it is going to move your booking for technical reasons; or
15.1.3 you have a legal right to end the contract because of something the relevant Wildland company has done wrong.
15.2 Even if the relevant Wildland company is not at fault, you can still end the contract before your booking dates, but you may have to pay compensation to the relevant Wildland company. If you want to end the contract in these circumstances, just contact the central booking email address (bookings@nattergal.co.uk) to let us know. The contract will end immediately, and you will be charged, as compensation for the net costs the relevant Wildland company will incur as a result of your cancelling the contract, a percentage of the total booking fee calculated from the following table depending on the date on which you end the contract. You may also be charged an administration fee in respect of any refund due. You will be advised of any such fee prior to any refund being made.

16 How to cancel a booking
16.1 To cancel a booking with us, please let the relevant Wildland company know by doing one of the following:
16.1.1 By email. Email bookings@nattergal.co.uk Please provide your name, details of the booking and, where available, your phone number and email address.
16.1.2 By phone. Call us on 07908850553 including the information required in paragraph 16.1.1.
17 Our rights to end the contract
17.1 The relevant Wildland company may end the contract for your booking at any time by writing to you if:
17.1.1 we believe that your booking may include illegal acts or activities, which might contravene our operating licenses, or we consider that your booking may damage the reputation or image of Nattergal or any of the Wildland companies;
17.1.2 you do not, within a reasonable time of being asked for it, provide information that is necessary for the relevant Wildland company to provide services relating to your booking; or
17.1.3 You do not comply with any of the terms contained in paragraph 10 and 11 or any other rules staff make you aware of during your booking.
17.2 If we end the contract in the situations set out in paragraph 17.1, you will not be entitled to any refund of your booking fee.
17.3 We may need to cancel your booking because of an event outside our control. If that is the case, paragraph 21 will apply.

18.2 If you are a consumer, the box below sets out a summary of your key legal rights in relation to your booking. Nothing in these terms will affect your legal rights.
Summary of your key legal rights
The Consumer Rights Act 2015 says
· you can ask the relevant Wildland company to repeat or fix a service if it’s not carried out with reasonable care and skill or get some money back if it can’t fix it.
· If you haven’t agreed a price upfront, what you’re asked to pay must be reasonable;
· if you haven’t agreed a time upfront, it must be carried out within a reasonable time.
19 Responsibility for loss or damage suffered by you, if you are a consumer
19.1 This paragraph 19 only applies if you are a consumer.
19.2 If the relevant Wildland company fails to comply with these terms, it is responsible for loss or damage you suffer that is a foreseeable result of it breaking this contract or our failing to use reasonable care and skill, but it are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both the relevant Wildland company and you knew it might happen, for example, if you discussed it with us during the booking process.
19.3 The relevant Wildland company is not liable for business losses and, accordingly, the relevant Wildland company will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
19.4 The relevant Wildland company does not exclude or limit any liability for which it would be unlawful for it to do so, including but not limited to death or personal injury caused by its negligence, or for its fraud or fraudulent misrepresentation.
20 Responsibility for loss or damage suffered by you, if you are a business customer
20.1 This paragraph 20 only applies if you are a business customer.
20.2 Nothing in these terms limits or excludes the relevant Wildland company’s liability for:
20.2.1 death or personal injury caused by our negligence; or
20.2.2 fraud or fraudulent misrepresentation.
20.3 Subject to paragraph 20.2 the relevant Wildland company will under no circumstances whatsoever be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the contract for:
20.3.1 any loss of profits, sales, business, or revenue;
20.3.2 loss or corruption of data, information or software;
20.3.3 loss of business opportunity;
20.3.4 loss of anticipated savings;
20.3.5 loss of goodwill;
20.3.6 loss of or damage to property or vehicles belonging to you or your guests, however caused; or
20.3.7 any indirect or consequential loss.
20.4 Subject to paragraph 20.2, the relevant Wildland company’s total liability to you in respect of all losses arising under or in connection with the contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the aggregate value of the contract.
20.5 Except as expressly stated in these terms, the relevant Wildland company does not give any representation, warranties or undertakings in relation to your booking and the services to be provided. Any representation, condition or warranty which might be implied or incorporated into these terms by statute, common law or otherwise is excluded to the fullest extent permitted by law.
21 Events outside our control
21.1 The relevant Wildland company will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations under the contract that is caused by an event outside its control.
21.2 You understand that despite the best efforts of the relevant Wildland company, your booking may be affected by an event outside its control. In such circumstances, it may change, postpone, or cancel your booking.
21.3 If the relevant Wildland company has to cancel your booking because of an unforeseen event, it will tell you as far in advance as possible and will arrange for a full refund of all monies paid to it (subject to any applicable administration fee) in respect of your booking (unless it is due to your failure or fault) but will have no other obligation or liability to you.
21.4 An event outside the relevant Wildland company’s control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport, building works or ground-works
22 Your personal information
22.1 All personal information stored and used by Nattergal and or the relevant Wildland company is done so in accordance with Nattergal’s Privacy Policy..
23 Other important terms
23.1 The relevant Wildland company may transfer its rights and obligations under these terms to another organisation.
23.2 You may only transfer your booking under these terms to another person if the relevant Wildland company agrees to this in writing.
23.3 This contract is between you and the relevant Wildland company. No other person except Nattergal Limited shall have any rights to enforce any of its terms.
23.4 Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
23.5 If the relevant Wildland company does not insist immediately that you do anything you are required to do under these terms, or if it delays in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent the relevant Wildland company taking steps against you at a later date.
23.6 If there is a conflict or inconsistency between these terms and the booking form, the booking form will take precedence.
23.7 If you are a consumer, please be aware these terms are governed by English law and you can bring legal proceedings in respect of your booking (and the contract) in the English courts. If you live in Scotland you can bring legal proceedings in respect of your booking (and the contract) in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of your booking (and the contract) in either the Northern Irish or the English courts.
23.8 If you are a business customer, your booking (and the contract) and any dispute or claim arising out of or in connection with it or its subject matter shall be governed by and construed in accordance with English law. The relevant Wildland company and you both irrevocably agree that the English courts shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with your booking (and the contract) or its subject matter.
